Welcome to GetPromptlyHired! These Terms of Service ("Terms") govern your use of our website, browser extension, and the services we provide (collectively, the "Service"). Please read them carefully.

Introduction and Acceptance of Terms

The Service is owned and operated by Delmag Innovations ("getpromptlyhired", "we", "our" and "us"). For all correspondence, please contact us at [email protected].

By creating an account, using our Service, or clicking "I agree," you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the Service.

Description of the Service

GetPromptlyHired is an AI-powered platform designed to assist job seekers. Our Service allows you to upload your resume and define your career preferences to:

  • Analyze job descriptions from job boards you access (e.g., LinkedIn, Indeed, and other supported sites).
  • Receive a Personalized Match Score with a detailed Score Breakdown.
  • Receive an AI Job Post Risk Analysis to identify potential red flags.
  • Identify Missing Skills and potential critical mismatches based on your preferences.
  • Generate AI-powered suggestions, resume bullet points, and cover letters tailored to specific job analyses.
  • Track your job applications and view Your Personal Strategy Dashboard for data-driven insights.

The features and functionality of the Service may be updated, modified, or discontinued at our sole discretion without prior notice.

User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information during the setup process.
  • Keep your password confidential and be responsible for all activities that occur under your account.
  • Be at least 18 years of age or the legal age of majority in your jurisdiction.

User Content and Data

Your Ownership of Content: You retain full ownership of the content you upload to the Service, including your resume, personal details, and career preferences ("User Content").

Limited License to Us: By uploading User Content, you grant GetPromptlyHired a limited, non-exclusive, worldwide, royalty-free, sublicensable license to use, store, process, reproduce, analyze, modify, and display your User Content solely to the extent necessary to provide, maintain, and improve the Service for you. This license includes the right for us to use third-party service providers (e.g., cloud hosting, AI model providers) in the operation of the Service.

User Responsibility for Content: You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to all of your User Content and that its use by us as contemplated in these Terms will not infringe upon or violate the rights of any third party, including intellectual property and privacy rights. We are not responsible for the accuracy, legality, or appropriateness of the User Content you submit.

Anonymized Data for Improvement: To improve our AI models and the Service for all users, we may use anonymized and aggregated data derived from your User Content and usage. This data will have all personally identifiable information removed and cannot be linked back to you. We will never use your identifiable personal data for AI training.

Fees, Payments, and Access Passes

Access Passes: Paid features of the Service are offered through the purchase of a one-time "Access Pass." An Access Pass grants you a specific number of analysis credits that can be used within the Service.

One-Time Purchase: All Access Passes are a one-time purchase and do not auto-renew. You will not be charged again unless you choose to purchase another Access Pass.

Payment: All payments are processed through our third-party payment processor. You agree to provide them with valid and up-to-date payment information and to abide by their terms.

Refund Policy: We provide 3 free analyses with full features (excluding dashboard analytics) so you can thoroughly evaluate the Service before purchase. Because you have full opportunity to test the product, all Access Pass purchases are final and non-refundable.

Exception: If a technical error on our end prevents you from accessing or using your purchased credits, contact [email protected] within 7 days of purchase. We will investigate and, at our sole discretion, may issue a refund or provide replacement credits.

Intellectual Property

Our Property: The Service itself, including our website, extension, branding (GetPromptlyHired name and logo), user interface, and all underlying technology, algorithms, and proprietary methods are the exclusive property of GetPromptlyHired and its licensors. Our proprietary methods and underlying technology that generate the Service's analyses and content—including but not limited to the Personalized Match Score, AI Job Post Risk Analysis, suggestions and longitudinal analytics—are the subject of a U.S. Patent Pending application

Ownership and Use of AI-Generated Content: While we retain all rights to the underlying AI models and the Service itself, you own the specific output of AI-generated content (e.g., resume bullet points, cover letters) that is generated for you through the Service. You are granted a broad, perpetual, worldwide license to use, modify, and reproduce this content for your personal and professional job-seeking activities. However, you are solely responsible for reviewing, editing, and verifying the accuracy and appropriateness of this content before use.

Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international laws or regulations.
  • Infringe on the intellectual property, privacy, or other rights of any third party.
  • Transmit any viruses, malware, or other malicious code.
  • Attempt to gain unauthorized access to our systems or user accounts.
  • Resell or commercially exploit the Service without our express written permission.
  • Use the Service in any manner that violates the terms of service of any third-party website, including but not limited to any job board from which you analyze a job description.
  • Use any automated means, such as bots or scrapers, to access, query, or otherwise collect information from our Service.
  • Place an unreasonable load on our infrastructure or interfere with the proper working of the Service.

Third-Party Service Dependencies

The Service is designed to interact with third-party websites and services (e.g., job boards like LinkedIn, Indeed). GetPromptlyHired is not affiliated with, endorsed by, or sponsored by any of these third parties. Your use of such third-party websites is governed by their respective terms of service and privacy policies. We do not control and are not responsible for the content, availability, or security of these third-party sites. We shall not be liable for any damages or loss caused by your use of or reliance on any third-party site, or for any interruption or cessation of our Service's functionality resulting from changes made by these third parties.

Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy. You must read and agree to the Privacy Policy before using the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NO GUARANTEE OF EMPLOYMENT OR CAREER SUCCESS: GETPROMPTLYHIRED IS A TOOL DESIGNED TO ASSIST YOU IN YOUR JOB SEARCH. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOMES. YOU ACKNOWLEDGE THAT WE DO NOT GUARANTEE THAT YOU WILL RECEIVE AN INTERVIEW, A JOB OFFER, OR ANY CAREER ADVANCEMENT AS A RESULT OF USING THE SERVICE. YOUR SUCCESS IS DEPENDENT ON NUMEROUS FACTORS OUTSIDE OF OUR CONTROL.

AI CONTENT AND ANALYSIS DISCLAIMER: ALL AI-GENERATED CONTENT, SCORES, ANALYSES, AND INSIGHTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY. THEY ARE NOT A SUBSTITUTE FOR PROFESSIONAL CAREER ADVICE OR YOUR OWN DUE DILIGENCE. AI MODELS MAY PRODUCE INACCURATE, INCOMPLETE, OR BIASED INFORMATION. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, VERIFYING, AND EDITING ALL AI-GENERATED CONTENT AND FOR ALL DECISIONS YOU MAKE BASED ON THE ANALYSES PROVIDED BY THE SERVICE.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETPROMPTLYHIRED, ITS OWNER, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF GETPROMPTLYHIRED EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless GetPromptlyHired and its owner from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

Termination

You can stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if you violate these Terms.

Governing Law and Dispute Resolution

Delmag Innovations is a registered business entity in India. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu, India.

Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you via email or by posting a notice within the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
